License Terms
Plain English. Read it in 3 minutes. If you license a photograph through The Set Decorator and use it on a film, TV, streaming, commercial, or stage production, these are the rules.
TL;DR
One license = one production. Unlimited use on that production, anywhere in the world, forever. No model releases needed (the photo is face-free). No attribution required, but appreciated. You can't resell the file. Money-back guarantee for 14 days if you didn't use it.
1. What you're licensing
You're buying a Royalty-Free · Film/TV Use Rights license for one digital photograph (the "Image"). The Image is a high-resolution JPEG you can download once, for 7 days, from the link in your purchase confirmation email.
The Image was created by Steve Abrams or by a contributing photographer who warrants ownership and granted The Set Decorator a license to sublicense the Image. Every Image in our catalog is screened to ensure no identifiable people are visible, removing the need for model releases under California Civil Code §3344 and equivalent state right-of-publicity statutes.
2. What you can do
- Use the Image on one (1) production, defined as a single film, single TV series, single commercial campaign, single video game, single streaming title, single stage production, or single editorial publication.
- Unlimited copies, screens, distribution channels within that production — theatrical, streaming, DVD/Blu-ray, festival, in-flight, broadcast worldwide, digital marketing materials, behind-the-scenes content.
- Perpetual term — the license does not expire. Once your production ships, you may continue to use the Image in every distribution channel for that production forever.
- Modify the Image — crop, retouch, color-grade, composite, animate, project-map. The artist's moral rights to integrity are waived for production use.
- Worldwide — every territory, every language, every platform.
- Behind-the-scenes credits — credit "Cleared art via The Set Decorator" is welcome but not required.
3. What you can't do
- Resell the Image file itself as standalone stock, on a marketplace, in an NFT, or as part of a clip-art bundle. You bought a use license, not the underlying copyright.
- Use the Image across multiple productions without a separate license per production. (Series → seasons of the same series count as one production. Reboots / spinoffs count as new productions.)
- Sublicense the Image to a third party, including affiliated companies, except as embedded in your finished production.
- Use the Image in trademarks, logos, or brand identity — that needs a separate Brand-Use license; contact us.
- Claim authorship — moral rights of authorship remain with the photographer.
4. Our warranty to you
The Set Decorator warrants that, at the time of your purchase:
- The photographer either created the Image personally or obtained ownership of the copyright in the Image.
- No identifiable people appear in the Image, removing model-release requirements.
- The Image does not include prominent trademarks or recognizable branded products in a way that would require trademark clearance.
- To our knowledge, no third party has a competing claim of right in the Image.
If a third party brings a claim against your production solely because of the Image, and the claim is rooted in a breach of the warranties above, we will defend and indemnify your production up to the amount you paid for the license, plus reasonable attorney fees, up to $10,000 USD total per Image.
This indemnity does not cover claims arising from your modifications, from your use of the Image in trademark / brand-identity contexts, or from your use beyond the scope of the license.
5. Refunds + takedowns
Refunds
If you haven't used the Image yet, you can request a full refund within 14 days of purchase by replying to your purchase confirmation email. We'll cancel the license and refund the full amount.
Takedown requests
If you believe an Image was uploaded to The Set Decorator in violation of your copyright, send a DMCA notice to dmca@thesetdecorator.com with: (a) your contact info, (b) the URL of the Image, (c) a statement of good-faith belief that the use is unauthorized, (d) a signature. We honor compliant DMCA notices within 24 business hours.
6. Liability
Except for the indemnity in Section 4, The Set Decorator's total liability under this license is limited to the amount you paid for the license, and excludes consequential, incidental, or punitive damages. We do not warrant that the Image meets your specific production needs or that it will be free of platform-specific delivery issues.
7. Termination
This license terminates automatically if you breach a material term and fail to cure within 30 days of written notice. On termination, you must stop new uses of the Image but may complete any production already in distribution.
8. Governing law
This license is governed by the laws of the State of California, without regard to conflict-of-laws principles. Disputes go to state or federal court in Los Angeles County. The parties waive jury trial.
9. Definitions
- "Production" means one specific creative work: one film, one TV series across all its seasons, one commercial campaign across all its versions, one streaming title, one stage production across all its venues, or one editorial article.
- "Use" includes display, reproduction, modification, distribution, and public performance.
- "You" means the buyer named on the Stripe receipt and any production entity for which the buyer was authorized to license the Image.
- "We" means The Set Decorator, a division of Designer Wallcoverings (15442 Ventura Blvd #102, Sherman Oaks, CA 91403).
